Abdoulaye Wade, Denis Sassou Nguesso, Teodoro Obiang Nguema et feu Omar Bongo sont visés par une plainte pour “détournement de fonds publics” déposée par l’association MLA. Les juges d’instructions du pôle financier doivent juger de sa recevabilité.
Quatre chefs d’Etat africains, dont le Sénégalais Abdoulaye Wade et le Congolais Denis Sassou Nguesso, sont visés depuis le 16 novembre par une plainte pour “détournement de fonds publics” déposée à Paris par l’association MLA, a-t-on appris vendredi de source judiciaire.
Une plainte recevable ?
L’association MLA “Le moment de se lever pour l’Afrique”, basée à Paris, a déposé le 16 novembre auprès du tribunal de grande instance de Paris une plainte avec constitution de partie civile visant, outre MM. Wade et Sassou Nguesso, le président de la Guinée-Equatoriale, Teodoro Obiang, et le défunt président gabonais Omar Bongo, selon cette source.
La plainte vise le chef de “détournement de fonds publics”. Il revient désormais à la doyenne des juges d’instruction du pôle financier, Françoise Desset, de juger de la recevabilité de cette plainte et d’ouvrir ou pas une information judiciaire, confiée à un juge d’instruction.
Cette plainte est dans la lignée de celles déposées en 2007 et 2008 par l’association anti-corruption Transparence internationale France (TI) visant MM. Obiang, Bongo et Sassou Nguesso et les conditions d’acquisition d’importants patrimoines immobiliers en France grâce, selon TI, à des détournements de fonds publics.

La doyenne des juges avait donné son feu vert en mai 2009 à l’ouverture d’une information judiciaire mais le parquet de Paris avait fait appel de cette décision. Le 29 octobre, la cour d’appel de Paris avait finalement jugé irrecevable cette plainte et avait bloqué l’ouverture d’une enquête.
La chambre de l’instruction de la cour d’appel avait notamment estimé que les plaignants ne pouvaient arguer d’un préjudice dans ce dossier.
Le parquet de Paris avait déjà classé sans suite à deux reprises, en novembre 2007 et septembre 2008, des plaintes simples visant les trois chefs d’Etat africains.
D’après TI France, le patrimoine immobilier de MM. Bongo, Obiang et Sassou Nguesso en France s’élèverait à 160 millions d’euros.
Le président Obiang a pour sa part déposé plainte à Paris pour dénonciation calomnieuse, a-t-on appris de source judiciaire. Selon son avocat, Me Olivier Pardo, elle est destinée à “lever l’opacité sur ces associations que personne ne connaît et qui prétendent se substituer aux Africains”.

Eine Beschwerde zulässig?
Der Verein MLA “Die Zeit, sich für Afrika” mit Sitz in Paris, eingereicht 16. November mit dem Tribunal de Grande Instance de Paris eine Beschwerde mit einer Zivilklage, zusätzlich zu MM. Wade und Sassou Nguesso, Präsident von Äquatorialguinea, Teodoro Obiang, und des Verstorbenen Gabunische Präsident Omar Bongo, sagte die Quelle.
Die Beschwerde soll der Leiter der “Missbrauch öffentlicher Gelder”. Es ist nun die älteste der Richter-polig, mit Françoise Desset, Richter die Zulässigkeit der Beschwerde und ob eine strafrechtliche Untersuchung, geleitet von einem Richter zu starten.
Diese Beschwerde ist im Einklang mit den im Jahr 2007 eingereicht und 2008 der Vereinigung der Anti-Korruptions-Frankreich Transparency International (TI) für MM. Obiang, Bongo und Sassou Nguesso und die Bedingungen für den Erwerb erheblichen Beitrag zur Wertschöpfung durch Immobilien in Frankreich, nach TI, Abzweigung öffentlicher Gelder.

Der Dekan der Richter hatte das grüne Licht Mai 2009 gegeben, um eine strafrechtliche Untersuchung offen, aber die Pariser Staatsanwaltschaft hatte das Urteil Berufung eingelegt. Am 29. Oktober des Berufungsgerichts von Paris endlich als unzulässig dieser Beschwerde hatte die Eröffnung einer Untersuchung blockiert.
Das Board of Education der Court of Appeal hatte entschieden, dass diese Kläger nicht den Verlust in diesem Fall geltend machen könnte.
Die Pariser Staatsanwaltschaft hatte bereits geschlossen, da zweimal im November 2007 und September 2008, Beschwerden für einfache drei afrikanischen Staatschefs.
Laut TI Frankreich, die Immobilien der MM. Bongo, Obiang und Sassou Nguesso in Frankreich belaufen sich auf 160 Mio. Euro.
Präsident Obiang hat wiederum beschwerte sich Paris für falsche Anschuldigung, erfuhr man, gerichtlichen Hand. Laut seinem Anwalt, Olivier Pardo, es soll “erhöhen Sie die Deckkraft dieser Verbände, dass niemand weiß, wer behauptet, die Afrikaner zu ersetzen.”

Four African heads of state, including Abdoulaye Wade of Senegal and the Congo Denis Sassou Nguesso, are affected since November 16 with a complaint for “abuse of public funds” made in Paris by the Association MLA, it was learned Friday judicial source.
A complaint admissible?
The Association MLA “The time to stand up for Africa”, based in Paris, filed November 16 with the Tribunal de Grande Instance de Paris a complaint with a civil action, in addition to MM. Wade and Sassou Nguesso, President of Equatorial Guinea, Teodoro Obiang, and the deceased Gabonese President Omar Bongo, the source said.
The complaint seeks the head of “misuse of public funds”. It is now the oldest magistrates of pole, Françoise Desset, to judge the admissibility of the complaint and whether to start a criminal investigation, headed by a judge.
This complaint is in line with those filed in 2007 and 2008 the association of anti-corruption France Transparency International (TI) for MM. Obiang, Bongo and Sassou Nguesso and the conditions for acquiring significant wealth through real estate in France, according to TI, diversion of public funds.
Obiang reply
The Dean of the judges had given the green light in May 2009 to open a criminal investigation but the Paris prosecutor’s office had appealed the decision. On 29 October the Court of Appeal of Paris had finally deemed inadmissible this complaint and had blocked the opening of an investigation.
The Board of Education of the Court of Appeal had held that such plaintiffs could not claim a loss in this case.
The Paris prosecutor’s office had already closed because twice in November 2007 and September 2008, complaints for simple three African heads of state.
According to TI France, the real estate of MM. Bongo, Obiang and Sassou Nguesso in France amount to 160 million euros.
President Obiang has in turn complained to Paris for false accusation, it was learned judicial source. According to his lawyer, Olivier Pardo, it is intended to “raise the opacity of these associations that nobody knows who claimed to replace the Africans.”
